1. General Conditions of Membership

By purchasing a membership, class pack, session, or any other product or promotional offer from 24/7 Pilates Studio Pty Ltd trading as 24 Seven Pilates Club (“24 Seven Pilates”, “we”, “us”, “our”), you agree to be bound by these Membership Terms & Conditions (“Terms”).

These Terms apply to all memberships, sessions, services, studio access, and digital platforms operated by us.

All members and session pack holders must read, understand, and agree to our Member Waiver prior to participating in any classes, programs, or using studio facilities.

We reserve the right to amend these Terms from time to time, including pricing, access arrangements, studio rules, and policies. Where changes are material, notice will be provided via our website, email, or in studio signage. Continued use of our services after such notice constitutes acceptance of the updated Terms.

It is your responsibility to review the most current version of these Terms prior to using our services.

2. Studio Access & 24/7 Use

24 Seven Pilates operates as a 24/7 self access reformer Pilates studio.

Studio access may be unstaffed at certain times.

Members acknowledge they may be exercising without direct supervision.

Access is granted via individual credentials and must not be shared.

Allowing another person to enter the studio using your access credentials (including tailgating or unauthorised entry) is strictly prohibited and may result in immediate suspension or termination of membership without refund.

3. Contract Start Date & Billing

Membership fees will only be charged once the studio has a confirmed opening date and the premises are accessible for use.

Members may select their billing schedule (weekly, fortnightly, or monthly) at the time of purchase. Fees will be charged in advance according to the chosen schedule starting from the confirmed opening date.

If opening is delayed due to construction or readiness, no fees will be charged until the studio is operational.

The agreed start date will be communicated in writing and forms the official commencement of the membership contract.

4. Membership Types

4.1 Basic Membership

Billing:
Weekly, fortnightly, or monthly direct debit charged in advance

Access:
Unlimited reformer Pilates classes
24/7 studio access

Fees:
No joining fee

Minimum Term:
Three (3) months (90 days)

Conditions:
Memberships are personal and non transferable
Issued to a named individual only
Mandatory onboarding required
Failure to comply may result in suspension or termination

4.2 Founding Membership (12 Months)

Access:
Unlimited 24/7 studio access

Payment:
Weekly, fortnightly, or monthly direct debit charged in advance

Minimum Commitment:
Full 12 month contract

Founding pricing applies only during the initial term. To retain this pricing, a new 12 month contract must be entered.

If no new contract is signed, membership will roll into a Basic Membership at the prevailing rate.

Pauses:
Up to two pauses per contract
Minimum 1 week
Maximum total 4 weeks
Requests must be submitted in writing

Early Termination Fees:

• Within first 6 months: $1,040
• Between months 6 to 9: $750
• Between months 9 to 12: $560

Membership transfers may be approved at our discretion and require onboarding and a new agreement.

5. Onboarding Requirement

All first time members and session pack holders must complete mandatory onboarding during staffed hours before accessing the studio independently.

Failure to complete onboarding may result in restricted or suspended access.

6. Payments & Failed Transactions

Fees are charged in advance.

Failed payments may result in suspended access.

Repeated failed payments may result in cancellation.

You are responsible for keeping payment details current.

7. Membership Pauses & Cancellations

Cancellations

Permitted after the minimum 90 day term.

30 days written notice required before next billing cycle.

Cancellations must be submitted in writing and confirmed by us.

Pauses

Minimum pause of 1 week
Maximum of 4 weeks per calendar year

Requests must be submitted at least 7 days before next debit.

8. Missed or Late Cancellations

Classes missed or cancelled with less than 4 hours notice incur a $5 fee per session.

Charged to the nominated payment method.

9. CCTV & Security

The studio is fitted with CCTV for safety and security.

Footage is monitored by an independent provider and authorised management.

Used strictly for safety, security, and investigations.

10. Photography & Marketing Consent

By entering the studio you consent to photography or recording for promotional use.

If you do not wish to be recorded, notify staff prior to participation.

11. Dispute Resolution

Disputes should be submitted in writing to contact@24sevenpilates.com.

We will attempt resolution within 30 days.

If unresolved, matters may be escalated to relevant consumer authorities.

12. Governing Law

These Terms are governed by the laws of Victoria, Australia.

13. KioskPro Terms & Conditions

These terms apply to use of the KioskPro training app and digital content provided by:

YR Commercial Operations, LLC (USA)
or
U Be Fit Pty Ltd as trustee for the Stallworthy Business Trust (Australia)

Your use of the service is at your own risk.

The service is provided “as is” with no guarantees of availability, fitness for purpose, or results.

Users must:

• Be over 16 years of age
• Seek medical advice before exercising
• Use the service responsibly
• Comply with all applicable laws

The provider accepts no liability for injury, loss, downtime, or damages except where required by law.

Content is protected by copyright and may not be copied, redistributed, or modified.

Prohibited activities include:

• Reverse engineering
• Scraping or automation
• Sharing access
• Circumventing security
